Enforcing Justice

Updated: Feb 11, 2023

Today the cadet was able to personally observe the serving of a warrant to an individual and the following booking process of the arrested suspect inside the investigation section of the police station. According to the Police Operational Procedure Manual 2021; “The warrant of arrest is the written authority for the arresting officer when making an arrest or taking of a person into custody in order that he/she may be bound to answer for the commission of an offense. The head of the office to whom the warrant of arrest has been delivered for the implementation shall cause the warrant to be implemented within ten days from receipt. Within ten days after the expiration of such period, the police officer to whom it was assigned for implementation shall make a report to the judge who issued the warrant and in case of his/her failure to implement the same shall state the reasons thereof.[1] The manual also enumerates the procedures in the process of serving warrants of arrest.

During the serving of the warrant, I observe the personnel of Solano Police Station carrying themselves professionally and with dignity towards themselves and the suspect. The suspect was very much cooperative and compliant during the whole process. As we reached the station and start with the standard processing of the suspect with the taking of mugshots and fingerprints, I was able to see the theories being applied. For example, the method or technique used to take fingerprints. The questions that should be asked of the suspect regarding the documents that should be accomplished when booking a suspect.

A fair application of the law lessens the possibility of discrimination and helps to prevent unfair or biased treatment. This is because judgments should be based on the facts of the case, not on personal biases or prejudices, and the law should be applied equally to all people. In addition, ensuring that the law is applied fairly is crucial for fostering social harmony and averting lawlessness. When the law is perceived as fair and unbiased, it serves to discourage illegal action and encourages compliance with the law. As a result, society becomes safer and more organized.

Furthermore, if potential offenders feel they would be held accountable for their conduct, they are less inclined to participate in criminal behavior. This is why just enforcement of the law functions as a deterrent. This contributes to improving public safety and lowering overall crime rates.

In conclusion, it is crucial to uphold justice when implementing the law. Fairness is upheld, prejudice is avoided, social stability is encouraged, and public safety is improved. Building trust in the rule of law and preserving a free and democratic society depend on having a just legal system.
